1. Agreement to these Terms
These Terms of Service ("Terms") are a legal agreement between you ("User", "you", "your") and EARF Pty Ltd (trading as "EARF", "we", "us", "our"), the operator of POMO ("Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
2. About the Service
POMO is a browser-based productivity application that provides timing and session-management features. The Service may be updated, paused, or discontinued at our discretion. We may provide additional features or integrations subject to these Terms.
3. Eligibility
You must be at least 16 years old to use the Service, unless a lower age is permitted by applicable local law and supervised by a parent or guardian. By using the Service you represent and warrant that you have the legal capacity to enter into these Terms.
4. Your obligations and acceptable use
- Use the Service lawfully and in compliance with these Terms and all applicable laws and regulations.
- Do not attempt to disrupt, harm, or gain unauthorised access to the Service or the systems and networks that provide it.
- Do not use the Service to store or transmit material that is illegal, infringing, defamatory, abusive, or otherwise objectionable.
4.1 Developer tools, tampering and prohibited technical access
Accessing, using, or otherwise employing browser developer tools, debugging utilities, automated scripts, proxying, interception, or other technical means to inspect, modify, extract, or otherwise interfere with the Service in a way that circumvents intended functionality, copies service-side logic, exfiltrates data, or otherwise violates these Terms is strictly prohibited.
Examples of prohibited activity include (but are not limited to):
- Using developer tools or network proxies to alter client-side code or state in order to bypass restrictions or unlock functionality not explicitly provided by the Service.
- Attempting to read or extract data from other users' sessions, or the Service backend, via debugging, interception, or scripting tools.
- Running automated scraping, instrumentation, or attack tools against the Service or its APIs without explicit written permission.
We may detect such activity and may, at our discretion, suspend or terminate access, block offending IP addresses, or take any other lawful action we consider appropriate. Nothing in this section limits our rights under these Terms or applicable law.
5. Accounts, data and settings
POMO does not require a user account for core functionality. Settings and preferences may be stored locally in your browser (e.g., localStorage). We do not claim ownership of your personal data; however, by using the Service you consent to the processing described in our Privacy Policy. You are responsible for maintaining the security of your device and browser.
6. Intellectual property
All intellectual property rights in the Service and its content (including text, graphics, logos, designs, software and trademarks) are owned by EARF or licensed to EARF. Subject to your compliance with these Terms, EARF grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.
7. Third-party services and links
The Service may contain links to third-party websites or services, including EARF properties. Those links are provided for convenience only; we do not control and are not responsible for third-party content, terms or privacy practices.
8. Warranties and disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. EARF excludes all warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the extent permissible by law, in no event will EARF, its directors, officers, employees or agents be liable for any indirect, incidental, special, consequential or exemplary damages arising from your use of the Service. Our aggregate liability for direct damages is limited to AUD 500 (or a different amount if required by applicable law).
10. Indemnity
You agree to indemnify, defend and hold harmless EARF and its representatives from any claim, loss, liability or expense (including legal fees) arising from your breach of these Terms or your misuse of the Service.
11. Termination
We may suspend or terminate your access to the Service at any time for any reason, including breaches of these Terms. Termination does not limit other remedies we may have.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will provide notice (for example via the Service or by email where possible). Your continued use after the effective date of changes constitutes acceptance.
13. Export controls
You must comply with all applicable export and import laws and may not use the Service in contravention of those laws.
14. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Australia. You and EARF submit to the non-exclusive jurisdiction of the courts of Australia to resolve disputes arising under these Terms.
